Any disputes, conflicts or differences arising from the performance of this Agreement ("Disputes") shall be resolved by the Parties by conciliation and negotiation. In the event that it is not possible to reach an agreement on the settlement of the Dispute within thirty (30) days from the date of the Dispute, each party has the right to request the Vietnam International Arbitration Center (VIAC) in addition to the Vietnam Chamber of Commerce and Industry (VCCI) to settle it according to the proceedings of this arbitral body. The place to settle the dispute will be in Ho Chi Minh City. The language of dispute resolution will be Vietnamese.
3.2. Severability
If any provision of this Agreement is invalid or unenforceable, in whole or in part, such invalidity or unenforceability shall not affect the validity of the remaining provisions, such other provisions shall remain in full force and effect.
3.3. Limitation of Liability
We shall not be liable for any costs, losses or damages whether direct or indirect, in connection with or as a result of the use or inability to use our Website by any party, or in connection with non-operation, errors, omissions, interruptions, defects, or delays in operation or transmission, due to computer viruses or transmissions or system interruptions beyond our reasonable control.
3.4. Indemnity
You agree to indemnify and hold our Website, its affiliates and the directors, officers, agents and employees of our Website completely harmless from any claims, damages, losses (including but not limited to loss of profits), and costs including, attorneys' fees arising out of or as a result of your breach, failure to, omission or delay of any of the terms and conditions of these Terms of Use and/or arising out of or in connection with these Terms of Use.
